Terms and Conditions

1. Acceptance of Terms

This document is an electronic record under the Information Technology Act, 2000 and applicable rules, including Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. It is published for https://www.doccliniq.com and related access channels (collectively, the "Platform").

Doccliniq is an online teleconsultation platform operated by Dr Rajesh Deshwal, a registered medical practitioner in India. The service is not offered by a separately incorporated company, LLP, or partnership. Platform technology and support are managed by Rushil Deshwal. By accessing or using the Platform, you agree to these Terms and Conditions ("Terms") and incorporated policies (Privacy, Refund, Return, Shipping, Disclaimer, Contact & Grievance).

If you do not agree, do not use the Platform. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Platform Description

Doccliniq is a telemedicine platform that facilitates online medical consultations between registered healthcare professionals ("Doctors") and patients ("Patients"). Our services include:

  • Video consultations via secure video conferencing
  • Voice consultations via audio calls
  • Chat consultations via text messaging
  • Digital prescription services
  • Appointment booking and management
  • Medical record storage and management

All consultations are conducted in accordance with the Telemedicine Practice Guidelines 2020 issued by the Board of Governors, Medical Council of India (MCI).

3. Eligibility and Account Registration

To use our Platform, you must:

  • Be at least 18 years of age or have parental/guardian consent
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Be responsible for all activities that occur under your account

For Doctors: You must hold a valid medical license recognized in India and provide proof of qualifications. Doccliniq reserves the right to verify credentials and may suspend or terminate accounts that fail verification.

4. Medical Consultations - Scope and Limitations

4.1 Non-Emergency Use Only

IMPORTANT: This Platform is intended for non-emergency medical consultations only. If you are experiencing a medical emergency, including but not limited to:

  • Chest pain or heart attack symptoms
  • Difficulty breathing or severe respiratory distress
  • Severe bleeding or loss of consciousness
  • Severe allergic reactions
  • Any life-threatening condition

Do NOT use this Platform. Immediately contact your nearest hospital, emergency department, or call emergency medical services (108 in India).

4.2 Online Consultations

All consultations provided through this Platform are online consultations. They are not a substitute for in-person medical examinations. For physical examinations, diagnostic tests, or procedures requiring direct physical contact, patients must consult with a local healthcare practitioner.

4.3 Doctor-Patient Relationship

The Platform facilitates connections between Doctors and Patients. The medical relationship exists directly between the Doctor and Patient. Doccliniq is a technology platform and does not provide medical services, diagnosis, or treatment.

5. Prescriptions and Medications

Prescriptions issued through the Platform are subject to:

  • Compliance with Telemedicine Practice Guidelines 2020
  • Restrictions on Schedule H, H1, and X medications as per Indian regulations
  • Doctor's professional judgment based on available information
  • Limitations of online consultations

Patients are responsible for obtaining medications from licensed pharmacies and following prescription instructions. Doccliniq is not responsible for medication availability, pricing, or adverse reactions.

6. Payments and Refunds

Payment for consultations is processed through Cashfree Payment Gateway (Cashfree Payments India Private Limited), an authorized third-party payment aggregator. By making a payment, you agree to Cashfree Payment Gateway's terms and conditions in addition to these Terms.

Consultation fees are displayed before booking. Payment must be completed within 5 minutes of appointment creation, or the appointment will be automatically cancelled.

Refund policies are detailed in our Refund and Cancellation Policy. Please review it before making a payment.

7. User Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Interfere with or disrupt the Platform's operation
  • Attempt to gain unauthorized access to any part of the Platform
  • Share your account credentials with others
  • Record consultations without explicit consent from all parties
  • Use the Platform to obtain controlled substances illegally

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, software, and the Platform's design, is the property of Doccliniq or its licensors and is protected by Indian copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without express written permission from Doccliniq.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Doccliniq provides the Platform "as is" and "as available" without warranties of any kind
  • Doccliniq does not guarantee the accuracy, completeness, or timeliness of information
  • Doccliniq is not liable for any medical decisions made based on consultations
  • Doccliniq is not responsible for technical failures, internet connectivity issues, or third-party service disruptions
  • Doccliniq's total liability shall not exceed the amount paid by you for consultations in the 12 months preceding the claim

Medical decisions and treatment outcomes are the sole responsibility of the treating Doctor and Patient. Doccliniq acts solely as a technology intermediary.

10. Indemnification

You agree to indemnify, defend, and hold harmless Doccliniq, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

11. Account Termination

Doccliniq reserves the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Misrepresentation of credentials (for Doctors)
  • Abuse of the Platform or other users
  • Non-payment of fees (for Doctors)

Upon termination, your right to use the Platform immediately ceases. We may delete your account and data in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Udaipur, Rajasthan, India.

Before initiating legal proceedings, parties agree to attempt good-faith negotiation and, if unsuccessful, mediation through a mutually agreed mediator.

13. Third-Party Services

The Platform integrates with third-party services including:

  • Cashfree Payment Gateway: Payment processing (card, UPI, net banking, and wallets as enabled on our merchant account)
  • Daily.co: Video and voice consultation infrastructure
  • Stream Chat: Chat consultation services
  • Google OAuth: Authentication services

Your use of these third-party services is subject to their respective terms and conditions. Doccliniq is not responsible for third-party service availability, functionality, or data handling.

14. Changes to Terms

Doccliniq reserves the right to modify these Terms at any time. Material changes will be notified via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

Emergency disclaimer: This platform is intended for non-emergency medical consultations only. In case of any medical emergency, seek immediate in-person care at the nearest hospital or emergency services. This platform does not replace emergency medical care.

Important notice: All consultations are online teleconsultations. For physical examination when required, consult a local healthcare practitioner.
